A Juvenile Court in Dhaka on Sunday declared Hasnatul Islam Faiyaz, a first-year HSC student of Dhaka College, to be a juvenile and cancelled the seven-day remand order issued by a Metropolitan Magistrate on Saturday.
The court sent Faiyaz to Gazipur's Tongi Child Correctional Centre.
This remand was in connection with the killing of police constable Gias Uddin during a quota reform movement in the capital's Jatrabari area on July 19.
Judge Roksana Begum Happy of the Juvenile Court-3 of Dhaka passed the order after Faiyaz's lawyer submitted an appeal challenging the legality of the lower court's order, confirmed Sub-Inspector Mohammad Asaduzzaman, the general recording officer of Jatrabari Police Station at the CMM Court.
During the hearing, Faiyaz's lawyer, Mozharul Islam, argued that his client is 17 years old. Despite submitting all documents proving Faiyaz's juvenile status, Dhaka Metropolitan Magistrate Shanta Akhter had placed him on a seven-day remand treating him as an adult. Therefore, the remand order by the lower court should be cancelled.
The Juvenile court then asked Moradul Islam, an inspector of the Detective Branch of Police and the investigation officer of the case, for his explanation. After verifying the documents, the IO confirmed Faiyaz's juvenile status.
