Honouring the martyrs of the Language Movement, the High Court (HC) on Wednesday announced its verdict in Bangla on the first day of February.
The HC bench of Justice Naima Haider and Justice Md Khairul Alam pronounced the verdict in a writ petition.
Advocate Md Shariful Islam was present in the court on behalf of the petitioner, while Deputy Attorney General Amit Dasgupta appeared for the state.
Before delivering the verdict, Justice Naima Haider said, “Today is the first day of the month of the Language Movement. Honouring the souls of the Language Movement martyrs and International Mother Language Day, today's first verdict is being given in Bangla. With respect to all Bangla speakers in the world, I am delivering this verdict.”
Lawyer Shariful Islam said, “Our case is a case related to entrusted property. The judgment of this case was announced by the High Court in Bengali. Besides, the court gave ruling and sent it to the appellate tribunal.”
The court in its judgment in Bengali said, “After discussion and review of counsel's arguments, we agree to settle this ruling without entering into the review of the merits of the suit with the following directions.”
The instructions are-
(a) The petitioner may file an appeal to the Appellate Tribunal against the return of vested property.
(b) If the petitioner wants to file an appeal in the Appellate Tribunal against the assigned property, the appeal must be filed within 90 days of receiving order.
(c) Restitution of vested property in appeal to the Appellate Tribunal shall be exempted.
(d) The order of restitution of under vested property shall remain in abeyance pending appeal to the Tribunal.
Status of possession will remain in place until the parties resolve the appeal. The writ case was settled.
